Distance Sales Agreement
This Distance Sales Agreement (the "Agreement") is concluded electronically between the parties identified below, in accordance with the Turkish Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

BUYER (MEMBER)
The natural or legal person who purchases the subscription as a member of the TadaPOS website (member-site). The buyer's name/title, address and contact details consist of the information collected through the Site during membership and ordering.
2. Definitions
- Law: Turkish Law No. 6502 on the Protection of Consumers.
- Regulation: The Regulation on Distance Contracts.
- Seller: Hayati Özoğlu (TadaPOS), who provides the service.
- Buyer: The member who purchases the service through the Site.
- Site: The tadapos.com website and the TadaPOS application.
- Service: The TadaPOS cloud-based software (SaaS) subscription.
3. Subject of the Agreement
The subject of this Agreement is to determine the rights and obligations of the parties, in accordance with the provisions of the Law and the Regulation, regarding the sale and provision of the TadaPOS subscription service that the Buyer orders electronically through the Site and whose characteristics and sales price are specified below.
4. The Service and Its Price
TadaPOS is a cloud-based software-as-a-service (SaaS) subscription offering POS billing, QR menu, table ordering, stock-recipe costing and reporting features for restaurants and cafés. There is no physical product delivery.
The monthly subscription fee for the service, including all taxes, is shown in the pricing section of the Site and in the order summary. Payment is collected securely through our payment infrastructure provider iyzico.
5. General Provisions
- The Buyer acknowledges that they have read and understood the preliminary information on the Site regarding the essential characteristics of the service, the sales price, the method of payment and the right of withdrawal, and has given the necessary confirmation electronically.
- The service is a digital service performed electronically and instantly; the Buyer accepts this nature.
- In cases of force majeure (natural disaster, infrastructure/communication outage, etc.), the Seller may temporarily suspend the service or may be unable to perform the agreement; in such cases the Buyer is informed.
6. Delivery and Access to the Service
The service is provided electronically and instantly upon completion of registration; an account is created and the login details are sent to the Buyer by e-mail. There is no shipping or physical delivery process. For details on delivery and access, please see the Delivery, Return & Cancellation Terms page.
7. Payment, Subscription and Renewal
Payments are collected by credit/debit card through the iyzico infrastructure. After the free trial period, the paid subscription begins only with the Buyer's explicit consent and renews automatically each month unless canceled. The Buyer may cancel the subscription at any time from account settings or by contacting the Seller.
8. Right of Withdrawal
As a rule, the Buyer has the right to withdraw within fourteen (14) days from the start of the performance of the service, without giving any reason. However, pursuant to Article 15 of the Regulation, the right of withdrawal cannot be exercised for services whose performance has begun with the Buyer's consent and which are performed instantly in electronic form, and for intangible (digital) services performed instantly and delivered to the Buyer. Since the trial period is free, the paid subscription begins with the Buyer's explicit consent.
9. Cancellation and Refund Terms
The subscription cancellation and refund terms are set out in detail on the Delivery, Return & Cancellation Terms page and form an integral part of this Agreement.
10. Privacy and Protection of Personal Data
The Buyer's personal data is processed and protected as explained in the Privacy Policy, within the scope of the Turkish Personal Data Protection Law No. 6698 (KVKK).
11. Default and Legal Consequences
In the event that the Buyer defaults on payments made by credit card, the Buyer accepts that they will pay interest within the framework of the credit card agreement between the cardholder and the bank, and will be liable to the bank in this respect.
12. Dispute Resolution and Competent Authority
For disputes arising from this Agreement, the Consumer Arbitration Committees at the place of residence of the Buyer or the Seller are competent within the monetary limits announced each year by the Turkish Ministry of Trade, and the Consumer Courts are competent for disputes above these limits.
13. Effective Date
The Buyer declares that they have read and accepted all the terms of this Agreement regarding the order placed through the Site and have confirmed the payment obligation. The Agreement enters into force at the moment it is approved electronically by the Buyer and the payment is completed.
